Legal Guidance - Flood Risk Assessment

The purpose of the Flood Risk Assessment is to strengthen and clarify the managment of flood risk and contribute to adapting to the impact of climate change. Flooding from rivers and tidal water is set to increase in frequency and intensity as a result of climate change. Consequently, the Government has replaced the Planning Policy Guidance (PPG) 25, 2001 with the Planning Policy Statement (PPS) 25, implemented in Oct 2006.

The PPS 25 Development and Flood Risk, sets out policies for planning authorities to:

• Ensure flood risk is properly taken into account at all stages of the planning process
• Prevent inappropriate development in areas at high risk of flooding
  
• Direct development away from areas of highest risk
• Positive planning has an important role in helping deliver sustainable development and applying the Governement's policy on flood risk management
• It aims to manage flood risk by taking full account of decisions on plans and applications of present and future flood risk; involving both the statistical pobability of flood occuring and the scale of its potential consequences, whether inland or on the coast
• The wider implications for flood risk of a development located outside flood risk areas

Other guidance such as PPS 1: Delivering Sustainable Developments , sets out the Government's objectives for the planning system: promoting sustainable patterns of development, avoiding flood risk and accommodating the impact of climate change.
