Legal Guidance – Foul Water

The most recent change regarding water issues in UK law was the amalgamation of the Water Resources Act 1991 and the Water Industry Act 1991 into a single piece of Legislation called the Water Act 2003. In addition, various other Regulations have also been adopted such as the:

• The Control of Pollution – (Applications, Appeals and Registers) Regulations 1996
• The Ground Water Regulations 1998
• The Water Resources (Abstracting and Impounding) Regulations 1996
• Water Resources (Environmental Impact Assessment) (England and Wales) Regulations (2003) 2006

The design of the foul water drainage systems needs to satisfy the requirements of the present Legislation, which is currently enforced by the Environment Agency.

The Water Framework Directive is the most important piece of Legislation which has come from our EU counterparts for decades, and came into force in December 2000 and transposed into UK Law in December 2003. It is designed to enhance all controlled waters and their ecosystems and to increase all waters to at least a “good” status by 2015.
